LED Light Therapy Device Hire Terms and Conditions

1. Introduction

These Terms and Conditions (the Agreement) govern the hire of an LED Light Therapy Device (the Device) by Love Skin With Aydan (the Provider) to the hirer (the Client). By hiring, collecting, or using the Device, the Client confirms they have read, understood, and agree to be bound by this Agreement.

2. Bond and Hire Fees

• A refundable security bond of $250 is required to secure the hire of the Device and must be paid in full prior to collection or delivery.

• The hire fee is $75 per week.

• Hire fees are non-refundable, including in circumstances of early return or non-use.

• The hire period commences on the date the Device is collected by or delivered to the Client and concludes on the agreed return date specified in the hire contract.

• Hire is charged at $75 per seven (7) day period. Where the hire period is shorter or longer than seven (7) days, charges will be pro-rated at a daily rate of $10.71 per day.

3. Bond Refund Conditions

• The security bond will be refunded only after the Device has been returned, inspected, and confirmed by the Provider to be in full working order, clean, and free from damage.

• The Provider reserves the right to partially or fully retain the bond where:

- The Device or any accessories are damaged, lost, missing, or returned in unsatisfactory condition;

- Cleaning, repair, or replacement is required due to misuse, neglect, or improper handling; or

- The Device is returned late.

4. Use of Device

• The Client agrees to use the Device strictly in accordance with all instructions and guidelines provided by the Provider.

• The Device must not be altered, modified, repaired, or tampered with in any way.

• The Device must not be sub-hired, loaned, or used by any person other than the Client or individuals authorised by the Client.

• The Client acknowledges that improper or incorrect use of the Device may result in injury, adverse effects, or damage.

5. Care and Maintenance

The Client agrees to:

• Keep the Device clean, secure, and stored safely when not in use;

• Protect the Device from moisture, heat, impact, spills, pets, and children; and

• Use only the power supply and accessories provided or approved by the Provider.

6. Loss, Theft, or Damage

• The Client assumes full responsibility and liability for the Device during the hire period.

• Any loss, theft, or damage occurring during the hire period remains the sole responsibility of the Client.

• In the event of damage, the Client agrees to pay the full cost of repair as determined by the Provider.

• In the event of loss or irreparable damage, the Client agrees to pay the full replacement cost of $699.

7. Return of Device

• The Device must be returned to the Provider on or before the agreed return date.

• Late returns will incur a daily late fee of $10.71 per day, which will be deducted from the security bond.

• Where late fees exceed the bond amount, the Client remains liable for the outstanding balance.

8. Liability and Medical Disclaimer

• The Client acknowledges that use of LED Light Therapy is undertaken at their own risk.

• The Provider accepts no liability for any injury, adverse reaction, or side effect arising from the use or misuse of the Device.

• The Client acknowledges that LED Light Therapy may not be suitable for all individuals and does not replace professional medical advice.

• The Device is not intended to diagnose, treat, cure, or prevent any medical condition.

9. Indemnity

The Client indemnifies and holds harmless the Provider from and against any claims, losses, damages, costs, or liabilities arising directly or indirectly from the use, misuse, or possession of the Device during the hire period.

10. Termination

• The Provider reserves the right to terminate this Agreement at any time, with or without cause.

• Upon termination, the Client must immediately return the Device to the Provider.

11. Agreement

By signing this Agreement, the Client confirms their acceptance of these Terms and Conditions and acknowledges full responsibility for the Device for the duration of the hire period.
